The website www.bimotoshop.it is managed by Bimoto di Maltry Renè, with registered and operational headquarters at Corso Matteotti 200/L Cecina (LI) Italy, VAT number 01782750507, tax code MLTRNE62M22Z133F. Bimoto di Maltry Renè is not responsible for any direct or indirect damages that may result from the use of the website. The website and its contents may be modified or replaced without prior notice. All prices include 22% VAT, excluding shipping costs. Each order will be accompanied by a regular fiscal receipt or commercial invoice (only if expressly requested at the time of order). The customer can only purchase products present in the bimotoshop.it electronic catalog at the time of placing the order and viewable online. All products marked "race" are designed and manufactured exclusively for competitive use and on closed circuits.

Warnings: Bimotoshop.it declines all responsibility for damages of any kind, physical or material, due to incorrect or inappropriate use, application, or assembly of all non-approved items.

Purchase Methods

The contract stipulated between Bimotoshop.it and the customer is considered concluded with the customer's acceptance of the sales conditions by clicking "Confirm Order" on the Purchase Form.

Bimotoshop.it will send an Order Confirmation email to the customer as an acceptance of the order. Once the online purchase procedure is completed, the customer will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Legislative Decree 206/05 (Consumer Code).

Shipping

Bimotoshop.it delivers its products within the Italian national territory and ships with GLS, BARTOLINI or SDA courier.

We ship in 1 business day for all products available in our warehouse. In the event that a product appears available during purchase but is no longer available, the customer will be contacted immediately. The customer will be entitled to withdraw from the order, unless a new deadline can be redefined together.

For products not available in stock, it will be necessary to wait for the product to be received from the manufacturer before it can be shipped to the customer. The customer will be informed of the product receipt times via email, which will have been provided to us at the time of registration on the portal.

Beta Motor brand products can always be ordered, regardless of our stock availability, as they are original spare parts that are ordered daily. If a product is not available in our warehouse or at Beta Motor, the customer will be contacted to redefine the purchase. Shipping costs include packaging and postage costs.

Product delivery costs are borne by the customer at the cost indicated at the time of order completion. Delivery costs are free for orders over €200, with some exceptions. Some products may offer free shipping.

What to do upon receipt of the package

When the courier makes the delivery, the customer must verify that: the package is intact, not damaged or wet, and in any case conforms to the standard characteristics of a package; the number of packages indicated on the waybill corresponds to the number of packages actually delivered.

Any complaints must be raised immediately with the carrier; in the absence of these, the product will be considered delivered correctly. If, upon receipt of the goods, the package is damaged or tampered with, it is necessary to: express a reservation: the package is accepted, but before signing the document, the customer must write "I accept with reservation because the package has the following anomaly ..... (describe the damage observed on the package)". This will allow, once the package is opened and any damage is found, to be compensated for the damage suffered. express to the carrier the unacceptability of the package due to tampering: refuse the package for a tampered package. Payment methods

Bimotoshop.it accepts the following payment methods:

Payment with Paypal: In case of payment with Paypal, Bimotoshop.it will redirect the "Order Completion" to the "Payments with Paypal" page. The customer only needs to enter their registered email and personal password and proceed with the payment.

Payment with Shopify Payments system: this payment method allows accepting credit, debit cards and fast methods (Apple Pay, Google Pay). Shopify Payments protects customer data with fraud detection methods and encryption such as 3D Secure.

Bank Transfer: Payment must be made within 5 days of order confirmation.

Right of Withdrawal

The customer intending to exercise the right of withdrawal (Legislative Decree no. 21/2014 implementing Directive 2011/83/EU) must, within 7 days of receiving the package, communicate their intention to return the purchased item or items via email to the following email address: info@bimotoshop.it.

Returns of goods are only accepted after agreements and prior authorization issued by bimotoshop.it via email, under the following conditions:

  • the item or items must be returned in their original packaging in perfectly intact, working, and resalable condition without modifications or alterations; electrical parts are excluded;
  • the fiscal receipt or invoice issued by Bimoto di Maltry Renè for the item in question, dated no earlier than 10 days, must be available; returns will not be accepted after this period;
  • returns of goods transferred or sold to third parties are not accepted; transportation costs for the return are at the expense of the transferor and are not refundable;
  • the goods must arrive at our premises within a maximum of 10 days from the return authorization;
  • the returned goods will be replaced with an identical or similar product of equal value, or the full amount of the items will be refunded, excluding the initial shipping cost;
  • the shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
  • in case of damage to the goods during transport, the customer will be informed of the incident to allow them to promptly file a claim against the courier of their choice and obtain a refund of the value of the goods (if insured);
  • in this event, the product will be made available to the customer for its return, simultaneously canceling the withdrawal request;
  • Bimoto di Maltry Renè is in no way responsible for damage or theft/loss of goods returned with uninsured shipments. If multiple products were purchased but only some were returned, the cost of the returned products will be refunded.

Warranty

All products sold by Bimotoshop.it are covered by the manufacturer's conventional warranty and a 24-month warranty for conformity defects, pursuant to Legislative Decree no. 24 of February 2, 2002. The manufacturer's conventional warranty is provided according to the methods illustrated in the documentation inside the product packaging and according to the manufacturer's instructions. The 24-month warranty pursuant to Legislative Decree no. 24 of February 2, 2002 is reserved for private consumers (natural persons who purchase goods for purposes unrelated to their professional activity, or who make the purchase without indicating a VAT number in the order form). In case of a conformity defect, Bimotoshop.it will send the item to the Manufacturer in order to restore the product's conformity through repair or, if not possible, replacement.

Privacy Policy

Pursuant to and for the purposes of Article 13 of Legislative Decree no. 196/2003 (Privacy Code) regarding personal data provided to Bimoto di Maltry Renè, owner of the site and subject to processing, the Customer or Reseller acknowledges and expressly approves the following. The personal data collected are exclusively those provided by the interested party by filling out the respective registration form for access to the service. Personal, common and sensitive data will be processed and used for the accounting and administrative management of the relationship or service, including accounting surveys and registrations, the execution of contractual relationships, the fulfillment of obligations provided for by laws, regulations or Community legislation, by provisions issued by authorities legitimate under law and by supervisory and control bodies, the fulfillment of contracts with suppliers, for the transfer of goods and for the provision of services, as well as for the fulfillment of statutory, contractual and regulatory obligations within the scope of Bimoto di Maltry Renè's activity.

Among them:

  • send informational or advertising material to the interested party and carry out commercial communications, including interactive ones;
  • carry out activities aimed at the sale or placement of goods or services;
  • process studies and statistical research on sales, customers, and other information, marketing activities, and possibly communicate them to third parties;
  • transmit the data thus collected and processed to third parties for legitimate commercial and/or statistical purposes, and also for the purchase and sale of goods or services. The data provided will be processed and stored by Bimoto di Maltry Renè in accordance with current regulations for the purposes mentioned above and for future relationships that may be established, unless the interested party expressly revokes authorization for processing.

The processing is carried out by means of any operation or set of operations among those indicated in art. 4, co 1, Legislative Decree 196/2003 and is carried out with the aid of manual or computerized tools; the data provided will be stored on magnetic or paper supports always in compliance with the minimum security requirements provided by law and may be disclosed to employees, consultants and external lawyers of the company in charge of processing for the aspects that may concern them as well as for the administrative and fiscal management of the relationship.

The interested party is free to provide their personal data. Refusal to provide personal data does not allow the use of the online sales services of the www.bimotoshop.it website. The personal data provided may be communicated to employees, external consultants, accountants, lawyers, credit institutions, service and consulting companies. As part of its activity, Bimoto di Maltry Renè may also communicate the data provided to third parties entrusted with the execution of activities directly connected and instrumental to the provision of Bimoto di Maltry Renè's services or with whom it has stipulated commercial agreements functional to the dissemination and development of the services to be provided.

  • to obtain the erasure, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
  • to obtain certification that the operations referred to in the two preceding paragraphs have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which such fulfillment proves impossible or involves a manifestly disproportionate use of means compared to the protected right;
  • to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning him/her, even if pertinent to the purpose of the collection;
  • to object to the processing of personal data concerning him/her for the purpose of sending advertising material or direct selling or for carrying out market research or commercial communication.

The deletion of personal data provided can be requested by the same means. Should Bimoto di Maltry Renè be requested to delete the personal data provided, the Company will proceed without delay to do so without further notice and/or communication. Such deletion, if the deleted data are necessary for the services provided or for the relationships established, may entail the immediate cessation of the same.

The sales contract between the Customer and Bimoto di Maltry Renè is concluded in Italy and governed by Italian Law. For any dispute, if the Customer is a consumer, the territorial jurisdiction is that of the judge of the consumer's place of residence or domicile, pursuant to art. 63 of Legislative Decree no. 206/2005 (Consumer Code); in all other cases, the territorial jurisdiction is exclusively that of Livorno.
